PARTICIPANT AGREEMENT, WAIVER, AND RELEASE FORM

In consideration of the right to register for and participate in the educational classes on building/home repair and improvement (the “Classes”) provided by Rethos: Places Reimagined (“Rethos”), I understand and agree as follows:

1. I agree and acknowledge that participation in the Classes involves inherent risk and dangerous activities. I understand that I may have the opportunity to use many different types of hand tools and/or power tools that may cause severe injury and/or death and/or property damage. The risks of participating in the Classes include but are not limited to: trips and falls, bruising, foreign objects in skin or eyes, hearing damage, electric shock, cuts, and other injuries, including disability and the loss of limbs or life.
2. I understand and agree that, during the Classes, I am personally responsible for learning how to operate in the workshop space and participate in the Classes properly and safely. I agree that I am satisfied with any safety and other instructions given by Rethos, its instructors, coordinators, and volunteers and understand that refusal to comply with safety guidelines may result in dismissal from the Classes, without a refund.
3. I expressly consent to my likeness and voice, in the form of photos and recordings both video and audio, being captured and authorize Rethos to use said material for any purpose, including all commercial, publicity and fundraising purposes. I waive all claims for remuneration for said use based on invasion of privacy or any other reason.
4. I hereby expressly assume all risks and waive and release from liability Rethos and its officers, directors, employees, members, and agents (the “Released Parties”) from all claims, now known or hereinafter known, for any death, injury, loss, damage to property, or any other claim arising out of or in connection with my attendance or participation in the Classes, whether arising out of the negligence of Rethos or any Released Party or otherwise. I covenant not to make or bring any such claim against Rethos or any other Released Party, and forever release and discharge Rethos and all other Released Parties from liability under such claims.
5. I expressly understand and agree that to the maximum extent permitted by applicable law, my participation in the classes is at my sole risk, and the classes and all information provided in the classes is provided “As-Is” and without warranty of any kind. Further, to the maximum extent permitted by applicable law and regardless of the nature of the action or theory of liability, in no event will Rethos be liable for any lost profits, lost opportunity, lost savings, loss of goodwill, lost business, loss of anticipated benefits, or any indirect, special, incidental, consequential, punitive, or other damages arising out of or as a result of my participation in the classes, even if Rethos has been advised of the possibility of such damages.
6. Pursuant to Minn. Stat. §604.055, nothing in this agreement purports or intends to waive liability for damage, injuries, or death resulting from conduct that constitutes greater than ordinary negligence. If any portion of this agreement is held invalid, I agree that portion is severable, and the remainder of the agreement shall remain in full effect.
7. I affirm the above information is correct, true, and current and may be subject to verification. I further state that I have read and fully understand the rules and regulations of Rethos, and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges or legal action against me. This Agreement constitutes the sole and entire agreement of Rethos and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter.
8. I, the undersigned, intend to be legally bound by this agreement for myself, my heirs, executors, and administrators and understand that I am voluntarily giving up substantial legal rights, including the right to sue Rethos. I attest and verify that I am physically sound and I have voluntarily signed as my own free act. I understand that I cannot modify or cancel this agreement.
